Regulations for providing services by electronic means for the My Portfolio tool.

Section 1. General Provisions

  1. Regulations for providing services by electronic means for the My Portfolio tool (hereinafter: ‘Regulations’) have been drawn up to comply with the obligation referred to in Article 8(1)(1) of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2020, item 344);
  2. The Regulations set forth the rules for using the services of the My Portfolio tool (hereinafter: My Portfolio) and the conditions for the provision of services by the Service Provider to Users.
  3. The administrator of My Portfolio and the Service Provider is the Educational Research Institute – National Research Institute (Instytut Badań Edukacyjnych – Państwowy Instytut Badawczy) with its registered office at ul. Górczewska 8, 01-180 Warsaw.
  4. These Regulations are made available free of charge on the website https://mojeportfolio.ibe.edu.pl/ in a form that allows the My Portfolio User to save, store and present them free of charge. The content of these Regulations may be saved and reproduced by the User using any technique on any device for the purposes of using My Portfolio and the services provided therein.
     

Section 2. Definitions

For the purpose of these Regulations, the terms listed below shall be defined as follows: 

  • Skills Audit [PL: Bilans kompetencji] – a set of methods used to identify and analyse the knowledge, skills and social competences of an Individual User, in order to prepare a professional Development Plan; the Skills Audit can be conducted with a counsellor;
  • Counsellor – a person providing vocational or educational counselling who has a ‘counsellor account’ in My Portfolio, with whom an Individual User can share their My Portfolio account or its selected elements;
  • Evidence – an Individual User’s documents and works that confirm possession of the skills listed in My Portfolio; these may include: certificates of completed courses, other certificates, diplomas, drawings, photographs, references (from employers, colleagues, social organisations) in .pdf, .jpg, .png format and as links to online resources;
  • Learning outcomes – the knowledge, skills and social competences acquired in the learning process; individual learning outcomes consist of what a person knows and understands, what they are able to do, and what commitments they are prepared to make;
  • Awarding body – an entity that has obtained the authorisation to award qualifications in accordance with the Act of 22 December 2015 on the Integrated Qualifications System (Journal Laws of 2024, item 1606); 
  • Standard account – an account intended for an Individual User; in the case of Individual Users who are under 16 years of age, permission to set up an account must be given by a parent / legal guardian;
  • Professional account – an account for counsellors (‘counsellor account’), employers (‘employer account’) and awarding body representatives (‘awarding body account’); an account intended only for adults performing the roles cited above. 
  • Competences – the ability to undertake specific actions and perform tasks using one’s own experiences, knowledge and skills;
  • My Portfolio [PL: Moje Portfolio] – a tool for collecting, organising and sharing evidence of knowledge, skills and social competences as well as for preparing Development Plans;
  • Development Plans – objectives and the actions and competences necessary to achieve them; a development plan helps an Individual User to identify and define their knowledge, skills and social competences and to plan the next steps in their professional or educational career;
  • Portal – the way a person accesses the services offered by My Portfolio;
  • Employer – a person representing a company/institution who has an ‘employer account’ in My Portfolio, with whom an Individual User can share their My Portfolio account or its selected elements;
  • Awarding body representative – a person representing an awarding body who has an ‘awarding body account’ in My Portfolio, with whom an Individual User can share their My Portfolio account or its selected elements;
  • Data processing – an operation or set of operations performed on personal data or sets of personal data, by automated or non-automated means, such as collecting, saving, organising, streamlining, storing, adapting or modifying, downloading, reviewing, using, disclosing by transmission, disseminating or other types of sharing, adjusting or combining, restricting, deleting or destroying;
  • Folder – a functionality of My Portfolio that allows an Individual User’s achievements (including competences and evidence thereof) to be collected and organised in one place in the form of a ‘Main Folder – Entire Portfolio’ and ‘Thematic Folders’;
  • Individual User – a natural person who has set up a standard account in My Portfolio in order to use the functionalities and services of the Portal, in particular to collect, organise and share evidence of their knowledge, skills and social competences, as well as to prepare their Development Plans;
  • Portal User (‘User’) – a person with a registered My Portfolio account.

Section 3. Types and Scope of Electronic Services

  1. The Service Provider shall deliver services in accordance with the Regulations.
  2. My Portfolio is a tool for collecting, organising and sharing evidence of acquired competences.
  3. The service provided to the Individual User includes, among others:
    1. providing access to the information collected in My Portfolio by the Individual User on different areas of their life (education, professional experience, courses and training workshops, life experiences and social activities, special achievements) and the competences they have (including social competences and language skills), as well as evidence of competences (documents, e.g., certificates, diplomas or other works, e.g., links to multimedia materials, photos, drawings);
    2. the ability to establish an account and making this account available to other My Portfolio users: counsellors, employers and awarding body representatives;
    3. the ability to make Thematic Folders with grouped evidence and competences and sharing them with counsellors, employers or awarding body representatives;
    4. the ability to communicate with a counsellor / employer / awarding body representative via chat;
    5. the ability to generate a CV based on the data recorded in the ‘Main Folder – Entire Portfolio’ or in the ‘Thematic Folders’;
    6. the ability to prepare individual Development Plans;
    7. system notifications regarding, for example, information on account activation.

4. The service provided to the counsellor includes:

  1. the ability to set up a counsellor account in My Portfolio;
  2. the ability to receive access from an Individual User of My Portfolio to their account or to its selected elements (Main Folder – Entire Portfolio, Thematic Folders, CV, Development Plans);
  3. the ability to use My Portfolio to conduct a Skills Audit with the Individual User;
  4. the ability to communicate with the Individual User via chat;
  5. system notifications concerning, e.g., information about the Individual User making their account available, or information about the Individual User sharing a selected element (or withdrawing its availability).

5. The service provided to an employer includes:

  1. the ability to set up an employer account in My Portfolio tool;
  2. the ability to receive access from an Individual User of My Portfolio to their account or to its selected elements (Main Folder – Entire Portfolio, Thematic Folders, CV, Development Plans);
  3. the ability to communicate with an Individual User via chat;
  4. system notifications concerning, e.g., information about the Individual User making their account available, or information about the Individual User sharing a selected element (or withdrawing its availability).

6. The service provided to the awarding body representative includes:

  1. the ability to set up an awarding body account in My Portfolio tool;
  2. the ability to receive access from an Individual User of My Portfolio to their account or to its selected elements (Main Folder – Entire Portfolio, Thematic Folders, CV, Development Plans);
  3. the ability to communicate with an Individual User via chat;
  4. system notifications concerning, e.g., information about the Individual User making their account available, or information about the Individual User sharing a selected element (or withdrawing its availability).

7. Access to the services provided is free of charge, which means that there is no payment required of users for the use of all the functions of My Portfolio.

Section 4. Technical Conditions

  1. To use My Portfolio, a device is needed with Internet access and an up-to-date version of one of the following browsers: Google Chrome, Mozilla Firefox, Microsoft Edge or Safari. In addition, JavaScript and cookies must be enabled in the User’s web browser.
  2. The site contains PDF documents, requiring the installation of the appropriate application to open them. We recommend the free Adobe® Reader, which can be downloaded from www.adobe.com.
  3. Electronic services are provided 24 hours a day, 7 days a week.
  4. Data sent using the form are protected by the Secure Socket Layer (SSL) protocol.
  5. By default, a login session ends after 20 minutes of inactivity.
  6. Closing the User’s browser may result in the loss of data sent to My Portfolio. All settings affecting the maintenance or cancellation of a session are found in the User’s browser. 
  7. The My Portfolio tool checks the correct format for the e-mail address and password.

Section 5. User’s Rights and Obligations

  1. Each User is obliged to use My Portfolio in a manner consistent with the content of these Regulations, respecting the law, including the Act on copyright and related rights, and observing good manners.
  2. In particular, it is prohibited to:
    1. provide false, inaccurate or outdated information or personal data in connection with the use of the tool;
    2. provide content which violates generally applicable laws.
  3. A breach of the obligations referred to in items 1 and 2 may constitute grounds for blocking the User account.

Section 6. Conditions for the Conclusion and Termination of the Contract

  1. The contract for the provision of services by electronic means is concluded between the Service Provider and the User upon setting up the User account (upon registration) in My Portfolio. The contract is terminated when the User account is deleted by the User (at any time) or by the Service Provider. In such cases, the contract for the provision of electronic services shall terminate without any further declaration of intent being required.
  2. The Service Provider is entitled to delete the User account:
    1. at the request of the User,
    2. in the event that the User does not comply with the provisions set forth in the Regulations.
  3. The contract shall be concluded in Polish.

Section 7. Contact and Complaints

  1. The Service Provider shall exercise due diligence to ensure that My Portfolio functions properly. The User has the right to report concerns and errors in the functioning of the tool to the following address: info.walidacja@ibe.edu.pl or via the contact form on the website https://mojeportfolio.ibe.edu.pl/.
  2. The User of the services described above has the right to lodge a complaint about these services to the following address: info.walidacja@ibe.edu.pl.
  3. Notifications and complaints referred to in sub-sections 1 and 2 above should contain a detailed description of the problem, enabling the Service Provider to respond to the notification.
  4. The Service Provider may ask the User to provide additional information to the extent necessary to respond.
  5. The Service Provider shall not be liable for errors in data transmission, in particular, those caused by the failure of IT systems, telecommunications systems or power supply systems, nor for errors in data transmission resulting from delays in the operation of the external service provider providing data transmission, nor for damages caused by factors beyond the Service Provider’s control.
  6. For security reasons, the Service Provider shall have the right to block or temporarily suspend access to My Portfolio for the period of time necessary to remedy the risks or irregularities that have occurred.
  7. The Service Provider reserves the right to change the content of My Portfolio at any time.
  8. A response to a notification or complaint shall be given without undue delay, but no later than 30 days from the date of receipt of the notification.
  9. The person submitting the notification of a problem or complaint will be informed by e-mail, at the address indicated in the notification, on how the matter was resolved.

Section 8. Final Provisions

  1. These Regulations shall apply as of 15 September 2025.
  2. The applicable Regulations are available to the User at: https://mojeportfolio.ibe.edu.pl/.
  3. The Service Provider has the right to amend the provisions of these Regulations. The Service Provider will notify the User of changes to the provisions of the Regulations by publication on https://mojeportfolio.ibe.edu.pl/.
  4. The User is obliged to read and comply with the provisions contained in these Regulations before using the service.
  5. Use of My Portfolio by the User implies acceptance of the provisions of these Regulations.
  6. The language used in the relations arising from these Regulations shall be Polish.
  7. These Regulations shall be governed by Polish law.
  8. The competent court for disputes that may arise from the Service shall be the court with jurisdiction over the Service Provider’s registered office.
